These Terms of Service govern your use of Montex AI Assist, a service provided by Montex Digital. By creating an account or using Montex AI Assist, you agree to these Terms.
1. The Service
Montex AI Assist provides tools for creating and operating AI-powered website assistants, including knowledge ingestion, chatbot conversations, lead capture, website integration, and related features.
Features may change, improve, or be discontinued over time. We may modify the service when reasonably necessary to maintain, secure, or improve the platform.
2. Accounts
You are responsible for maintaining accurate account information and safeguarding access to your account.
You are responsible for activity performed through your account and for ensuring that authorized users comply with these Terms.
You may not use Montex AI Assist for unlawful, fraudulent, abusive, deceptive, or harmful purposes.
3. Customer Content
You retain ownership of the documents, website content, instructions, and other materials you provide to Montex AI Assist.
You grant Montex Digital permission to process that content only as necessary to provide, maintain, secure, and improve the service.
You are responsible for ensuring that you have the right to upload, process, and use the content you provide.
Do not upload information that you are not authorized to process through the service.
4. Chatbot Conversations and Leads
Your chatbots may receive information from website visitors, including messages and contact information.
You are responsible for how you use information collected through your chatbots and for complying with privacy, marketing, and other laws that apply to your business.
Montex AI Assist is a technology provider and does not determine how you use visitor information after it is provided to you.
5. Artificial Intelligence
AI-generated responses may occasionally be incomplete, inaccurate, or inappropriate.
You are responsible for configuring your chatbot, reviewing its knowledge sources and instructions, and determining whether Montex AI Assist is appropriate for your use case.
Montex Digital does not guarantee the accuracy of AI-generated responses or any particular business result.
You should not rely on Montex AI Assist as a substitute for professional legal, medical, financial, or other regulated professional advice.
6. Acceptable Use
You may not use the service to:
- violate applicable law
- infringe intellectual property or privacy rights
- distribute malware or malicious code
- attempt unauthorized access to systems or accounts
- interfere with the operation or security of the service
- generate or distribute unlawful, fraudulent, deceptive, or abusive content
- use the service in a manner that creates unreasonable technical load or risk
We may restrict or suspend accounts that materially violate these requirements.
7. Subscriptions and Billing
Paid subscriptions are billed according to the pricing displayed at the time of purchase.
Unless otherwise stated, subscriptions renew automatically until canceled.
You may cancel through the available billing controls. Cancellation prevents future renewal but does not ordinarily provide a refund for an already-paid billing period.
Usage allowances and plan features may vary by subscription.
Taxes may be added where required.
8. Third-Party Services
Montex AI Assist relies on third-party infrastructure and technology providers, which may include payment processing, hosting, storage, email delivery, and artificial intelligence providers.
Use of these services may be subject to their own terms and policies.
We are not responsible for outages or failures caused by third-party services outside our reasonable control.
9. Availability
We work to provide a reliable service, but Montex AI Assist is provided on an "as available" basis.
We do not guarantee uninterrupted operation, continuous availability, or that every feature will be free from errors.
Maintenance, security events, third-party outages, or other circumstances may temporarily affect availability.
10. Suspension and Termination
You may stop using the service at any time.
We may suspend or terminate access when reasonably necessary for security, nonpayment, abuse, legal compliance, or material violation of these Terms.
Where practical, we will attempt to provide notice before terminating an account for reasons other than urgent security, legal, or abuse concerns.
11. Disclaimer of Warranties
To the maximum extent permitted by law, Montex AI Assist is provided without warranties of any kind, whether express or implied.
We do not guarantee specific rankings, leads, sales, revenue, conversion rates, customer acquisition, or other business outcomes.
12. Limitation of Liability
To the maximum extent permitted by law, Montex Digital will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of Montex AI Assist.
To the maximum extent permitted by law, Montex Digital's total liability arising from the service will not exceed the amount you paid for Montex AI Assist during the three months preceding the event giving rise to the claim.
Some jurisdictions may not allow certain limitations, in which case those limitations apply only to the extent permitted by law.
13. Changes to These Terms
We may update these Terms from time to time.
If changes are material, we will take reasonable steps to provide notice. Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms.
14. Privacy
Use of Montex AI Assist is also subject to our Privacy Policy, which explains how information is collected, used, and handled.
